Terms of Service

1. Acceptance of Terms

By creating an account and using Elitified®, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the service.

• You must be 18 years or older to create an account independently
• Users aged 13–17 may only use the app with verified parental or guardian consent obtained through our in-app consent flow
• Users under 13 are not permitted to use the app under any circumstances
• If you are uploading video of a child (under 18), you warrant that you are the parent or legal guardian of that child and consent on their behalf

2. Description of Service

Elitified Pty Ltd provides AI-powered sports technique analysis. The service works as follows:

• Users upload video of themselves or children in their care performing sports techniques
• Videos are compared against elite athlete reference videos in our curated library
• AI analysis is performed by Google Gemini API, producing phase-by-phase feedback, similarity scores, and personalised drill recommendations
• Results and coaching suggestions are stored in your account for the life of the account
• Every new account receives one free analysis — no credit card required
• Public sample reports are available at elitified.com/sample-report without requiring an account
• Paid subscriptions unlock higher monthly analysis limits and additional features (see Section 9)

3. Video Upload Rules and Consent

Who You May Upload

• You may only upload video of yourself OR children for whom you are a parent or legal guardian
• You must NOT upload video of third parties without explicit consent
• You must NOT upload video of other people's children under any circumstances

Content Requirements

• Video of children must only show sports technique performance in appropriate athletic attire
• No other context is permitted
• Elitified reserves the right to immediately terminate accounts where these rules are breached

License and Data Use

By uploading video, you grant Elitified Pty Ltd a limited license to process that video solely for the purpose of providing the analysis service.

• Elitified Pty Ltd does NOT use uploaded videos to train AI models
• Elitified Pty Ltd does NOT share uploaded videos with any third party except Google (Gemini API) for the purpose of analysis
• Videos are retained for the life of your account so you can review them alongside your coaching feedback. You can delete any individual video at any time from your analysis history, or all videos at once from Account Settings. On account deletion, all videos are permanently removed within 30 days.

4. Intellectual Property

• You retain full ownership of videos you upload
• Elite reference videos in the Elitified library are licensed content — you may not download, copy, or redistribute them
• The Elitified® platform, brand, and AI analysis output format are the intellectual property of Elitified Pty Ltd. "Elitified" is a registered trademark.

5. Prohibited Uses

You must not use Elitified to:

• Upload video of any person without their consent
• Upload video of children for whom you are not a parent or guardian
• Upload video containing nudity or inappropriate content
• Attempt to reverse engineer or extract the AI analysis system
• Share account access with other people
• Use the platform for any commercial purpose without written agreement with Elitified Pty Ltd

7. Limitation of Liability

• Elitified Pty Ltd provides coaching suggestions only — not professional medical, physiotherapy, or sports science advice
• You should consult qualified professionals before undertaking training programs
• Elitified Pty Ltd is not liable for injury resulting from following AI-generated coaching suggestions
• Our maximum liability is limited to the subscription fees you paid in the 3 months prior to any claim

8. Governing Law

• These terms are governed by the laws of Queensland, Australia
• Disputes will be resolved in Queensland courts
• For users in the EU: your statutory consumer rights under applicable EU law are not affected by these terms

9. Subscriptions and Billing

• Paid subscriptions (Starter, Pro, Elite) are billed monthly in advance via Stripe
• Subscriptions automatically renew each month until cancelled
• You may cancel at any time through the Billing Portal in Account Settings — cancellation takes effect at the end of the current billing period
• No refunds are issued for unused portions of the current billing period
• On cancellation or account downgrade, access to paid features continues until the end of the paid period
• Organisation accounts are set up and invoiced directly by the Elitified team under separate agreement
• Elitified Pty Ltd reserves the right to change subscription pricing with 30 days notice to existing subscribers

10. Changes to Terms

Elitified Pty Ltd may update these terms from time to time. We will notify you of any material changes by email at least 30 days in advance. Your continued use of the service after the notice period constitutes acceptance of the updated terms.
